Federal DUI

A federal crime is any act that is considered illegal according to federal legislature or any criminal act that occurs on federal property. According to U.S. law, federal property is defined as any land under federal jurisdiction. Federal property includes airports, national parks, courthouses, and government buildings. If a person is charged with a federal crime, his or her case will progress to federal court.

DUI as a Federal Crime

Like all other crimes, driving under the influence can be a federal crime if the act occurred on federal property. Different types of federal property are governed by different laws. For example, the National Park Service sets forth the Code of Federal Regulations that governs national parks.

According to the Code of Federal Regulations, a person can be charged with driving under the influence on federal property under the following conditions: he or she is impaired by drugs and/or alcohol while operating a motor vehicle; he or she is driving with a blood alcohol concentration of either - .10 grams or more of alcohol per 100 milliliters of blood or .10 grams or more of alcohol per 210 liters of breath; or he or she is driving with a blood alcohol concentration above the limit established under state law if state law is more restrictive.

When law enforcement believes a person to be operating a motor vehicle on federal property while under the influence, a law enforcement officer will ask the person to submit to a blood alcohol test. The person must then consent to a breath, blood, or urine test before his or her blood alcohol concentration can be determined. A person may refuse to take the blood alcohol test; however, refusal to submit to testing can result in the loss of driving privileges on federal land for up to a year.

If a person is charged with and convicted of DUI on federal property, he or she faces serious legal consequences, which may include jail time, large monetary fines, and probation.
