DUI Penalties
In California, DUI penalties are set forth by strict state statutes. When a person is convicted of DUI, the judge will refer to these statutes when deciding upon a just sentence. In all cases, the DUI penalties will be affected by the facts surrounding the person's arrest, the person's BAC test results, local policies, and the ability of the prosecutor. Sometimes, DUI penalties are subject to enhancements.
Penalties may be enhanced if the offender has a prior DUI conviction, was speeding 20 mph over the legal limit, refused to submit to blood alcohol testing, or had a minor below the age 14 in the car with him/her.
Below is a list of non-enhanced legal penalties for 1st, 2nd, 3rd, and 4th DUI convictions:

- Jail: 48 hours to 6 months
- Fine: $390.00 to $1,000.00, with possible penalty assessments
